Are You a Person with a
Disability?
- A person with a disability has a physical or
mental impairment such as those related to:
hearing vision mobility HIV infection
mental retardation alcoholism multiple chemical
sensitivity chronic fatigue head injury learning
disability psychiatric disability drug addiction or other
conditions
that substantially limits one or more major life
activities, such as:
walking hearing seeing breathing learning speaking
or has a record of such impairment or is
treated as having such an impairment.

Who is Protected?
The FHAA added persons with a "handicapping condition",
along with families with children, as protected classes under the Civil Rights
Act. The legislation adopts the definition of handicapping condition found in
Section 504 of the Rehabilitation Act of 1973, as amended. This definition
includes any person who actually has a physical or mental impairment, has a
record of having such an impairment, or is regarded as having such an
impairment that substantially limits one or more major life activity such as
hearing, seeing, speaking, breathing, performing manual tasks, walking, caring
for oneself, learning or working.
Is There Any Person with a Disability Who is NOT Covered by
this Act?
Yes. Someone who currently is illegally using drugs is not
covered.
But, someone who is in or has successfully completed a
drug-addiction recovery program is covered. |
